1. About this policy

This policy explains how FIVE92 Fabrications & Certified Welding & Certified Welding (ABN 29 698 330 915) (“FIVE92”, “we”, “us”, “our”) collects, uses, stores and discloses personal information.

It applies to this website (five92fabrications.com.au), our online merchandise store, and the personal information we collect when you enquire about or use our welding, fabrication, labour hire, equipment hire and inspection services.

As a small business, we may not currently be bound by the Privacy Act 1988 (Cth). Regardless, we think you’re entitled to know what happens to your information, so we’ve chosen to handle personal information in line with the Australian Privacy Principles (APPs) set out in that Act.

2. What personal information we collect

When you contact us or request a quote

Through our contact form, by phone, by email or in person: your name, phone number, email address, and whatever you tell us in your message — which may include your site address, project details and job requirements.

When you buy merchandise

Your name, email address, phone number, billing address, delivery address, order contents and order history.

Payment information

Card payments on our store are processed by Stripe. Your full card number, expiry date and security code are entered directly into Stripe’s systems and are not collected, seen or stored by us. We receive only a confirmation of payment and limited details such as the card type and the last four digits.

When you use our services as a client

Contact details for you and your site personnel, site access and induction details, purchase order and billing details, and correspondence about the job. For inspection and certified welding work, records may include the names and qualifications of personnel who performed or witnessed the work.

When you visit our website

Your IP address, browser and device type, operating system, referring page, the pages you view, and the dates and times of your visit. This is collected through cookies and similar technologies — see section 5.

If you comment on our blog

Your name, email address, website (if supplied), comment content and IP address.

What we don’t ask for

We don’t seek sensitive information (such as health information, or details of your race, religion or political views) through this website. Please don’t include sensitive information in a contact form or blog comment.

3. How we collect personal information

Usually directly from you — when you fill in a form, phone or email us, place an order, or talk to us on site.

Automatically, through cookies and analytics tools when you browse the website.

From third parties, occasionally — for example a builder or head contractor who refers you to us, a labour hire client, a publicly available business listing, or a message you send us through Facebook or Instagram.

If we receive personal information about you that we didn’t ask for and don’t need, we’ll destroy or de-identify it where it’s lawful and reasonable to do so.

4. Why we collect it and how we use it

We use personal information to:

  • respond to enquiries and prepare quotes
  • carry out fabrication, welding, labour hire, equipment hire and inspection work, and communicate with you while a job is running
  • process, fulfil and deliver merchandise orders, and handle returns or exchanges
  • issue invoices and collect payment
  • keep the records we’re required or advised to keep — including work health and safety records, weld and inspection records, and tax and financial records
  • verify identity and manage equipment hire arrangements
  • improve the website and understand how it’s used
  • send you marketing about our services, products or promotions, where you’ve agreed to receive it or would reasonably expect it (see section 11)
  • deal with complaints, disputes, insurance matters and legal claims
  • meet our legal obligations

If you don’t give us the information we ask for, we may not be able to quote for or carry out your job, or fulfil your order.

5. Cookies and website analytics

Essential and functional cookies. Our website runs on WordPress with WooCommerce. These set cookies that are necessary for the site to work — remembering what’s in your cart, keeping you logged in to your account, and maintaining your session while you check out. The site can’t function properly without these.

Analytics. We use Google Analytics (via the Site Kit plugin) to understand how visitors find and use the site — which pages are popular, how long people stay, and roughly where visitors are located. Google may set cookies and collect your IP address for this purpose. Google’s practices are described at policies.google.com/privacy, and you can opt out across all websites using Google’s browser add-on at tools.google.com/dlpage/gaoptout.

Managing cookies. You can block or delete cookies through your browser settings. If you block essential cookies, parts of the site — particularly the cart and checkout — will stop working.

6. Who we share personal information with

We disclose personal information to:

  • Stripe, our payment processor, to process card payments and handle refunds and chargebacks
  • Delivery and courier providers (for example Australia Post), to send merchandise orders — they receive your name, delivery address and contact details
  • Our web host, email provider and IT support, who store or have incidental access to information in the course of maintaining our systems
  • Google, through the analytics described above
  • Our accountants, bookkeepers, insurers, brokers and professional advisers, where relevant to our business
  • Subcontractors and labour hire personnel we engage to carry out your work, where they need your details to attend site or complete the job
  • Clients and principal contractors, where you are a worker we supply under a labour hire arrangement and they require your details for site access, induction or compliance purposes
  • Regulators, courts, insurers and law enforcement, where we’re required or authorised by law, or where it’s necessary to establish or defend a legal claim

We do not sell, rent or trade your personal information.

7. Overseas disclosure

Some of the providers above store or process information outside Australia. In particular:

  • Stripe processes payment information and may store it in the United States, Ireland and other locations where it operates
  • Google (analytics) may store information in the United States and other countries where it has facilities

Before disclosing personal information overseas we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles, but we can’t control the laws of another country.

If you’re in the European Union or United Kingdom, additional rights may apply to you under the GDPR or UK GDPR. Contact us using the details in section 16 and we’ll respond to your request.

8. How we keep it secure

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. These include serving the website over HTTPS, restricting access to the people who need it, keeping software and plugins updated, and using reputable providers such as Stripe for payment processing.

No website or electronic system is completely secure. We can’t guarantee the security of information you send us over the internet, and you send it at your own risk.

If a data breach occurs that is likely to result in serious harm, we will respond in line with the Notifiable Data Breaches scheme, which may include notifying you and the Office of the Australian Information Commissioner.

9. How long we keep it

We keep personal information only as long as we need it for the purposes described above, or as long as the law requires.

In practice:

  • Financial and tax records — at least 5 years, as required by the Australian Taxation Office
  • Work health and safety, weld and inspection records — for the periods required under the relevant work health and safety laws, Australian Standards and client contracts, which can be considerably longer
  • Quote enquiries that don’t proceed — 24 months
  • Marketing contact details — until you unsubscribe, plus a short period afterwards so we can honour your opt-out

When we no longer need personal information, we destroy or de-identify it.

10. Accessing and correcting your information

You can ask us for a copy of the personal information we hold about you, and ask us to correct it if it’s wrong, out of date or incomplete. Contact us using the details in section 16.

We’ll normally respond within 30 days. We don’t charge for making a request, though we may charge a reasonable fee for the cost of giving access in some circumstances. If we refuse a request, we’ll tell you why in writing and explain how to complain.

We may ask you to verify your identity before we release information.

11. Marketing and how to opt out

If we send you marketing emails or messages, every one will include an unsubscribe option. You can also ask us to stop at any time using the details in section 16, and we’ll action it promptly.

We handle commercial electronic messages in accordance with the Spam Act 2003 (Cth), and telemarketing in accordance with the Do Not Call Register Act 2006 (Cth). Both apply to us regardless of our size.

Opting out of marketing won’t stop us sending you messages we need to send about a job or order you’ve placed — quotes, job updates, invoices, delivery notifications and the like.

12. Complaints

If you think we’ve mishandled your personal information, please tell us first using the details in section 16. Set out what happened and what you’d like us to do. We’ll acknowledge your complaint, investigate it, and respond in writing — normally within 30 days.

13. Other websites

Our website links to other sites, including our Facebook and Instagram pages. This policy doesn’t cover those sites. We’re not responsible for how they handle your information — check their own privacy policies.

14. Children

Our website and merchandise store are intended for adults. We don’t knowingly collect personal information from children under 16. If you believe we’ve collected information from a child, contact us and we’ll delete it.

15. Changes to this policy

We may update this policy from time to time. The current version will always be available on this page, with the “last updated” date at the top. If we make a significant change, we’ll take reasonable steps to let you know.
